Annex 2 — TERMS OF REFERENCE
FOR THE CONSULTANCY CONTRACT OF: Housing Rights Analyst of War Veterans (Consultant)
- Duty Station of the Consultancy: Kyiv, Ukraine
- Duration of Consultancy: 6 months, with possibility of extension subject to availability funds and satisfactory job performance
- Nature of the consultancy: Category A

Under the overall supervision of the Chief of Mission (CoM), the direct supervision of the Operations Coordinator (T&R), and with the overall technical supervision of the National Reintegration and Reconciliation Officer, the Consultant will be seconded to the Ministry of Veterans Affairs (hereinafter referred to as «the Ministry») to provide support to the Ministry on matters related to ensuring housing rights for war veterans and family members of fallen (hereinafter referred to as «housing rights of war veterans»).
- Project Context and Scope: The impacts of the full-scale invasion of Ukraine are immediate in terms of humanitarian needs and protection concerns, and massive in terms of recovery, reconstruction, and prospects for stability. The International Organization for Migration (IOM) in Ukraine is thus harnessing the momentum created by national and international recovery efforts to support the creation of conditions to address the consequences of war and promote an integrated approach to reconstruction and development.

The Government of Ukraine (GoU) and the Ministry of Veterans Affairs have made significant progress in addressing the needs of veterans, their families, and the families of the fallen. However, to meet growing demands and ensure a cohesive approach, the Ministry requires technical expertise to enhance its capacity to amend and develop national legislation, with a particular focus on securing and strengthening housing rights for veterans. This support is crucial for ensuring that veterans have access to stable and adequate housing, which is an essential part of their reintegration and well-being.
IOM will provide technical support to the Ministry of Veterans Affairs in the development of policy, legislative, communication and administrative framework in the areas of the housing rights of war veterans and family members of the fallen (hereinafter referred to as the housing rights of war veterans).
The Housing Rights Analyst of War Veterans will provide ongoing support to the Ministry in its efforts to ensure the housing rights of war veterans and the families of fallen (hereinafter referred to as 'housing rights for war veterans'). This support will involve assisting with the development and implementation of policies and programs designed to facilitate access to housing for these individuals. The Consultant will help to monitor and evaluate the effectiveness of housing policies and programs, providing recommendations for improvements to meet the needs of veterans and their families.

- Category A Consultants: Tasks to be performed under this contract.
- Conduct a comprehensive analysis of existing legislation and regulatory frameworks in the following areas: Housing rights of war veterans, Accessible mortgage programs for veterans, Compensation for temporary accommodation expenses for internally displaced war veterans, The «eRecovery» program for war veterans, The«eOselya» housing initiative for war veterans.
- Perform an analysis of the best international practices related to the identified areas.
- Participate in meetings and consultations to discuss the development of necessary regulatory acts within the scope of housing rights.
- Develop a preliminary action plan for drafting the required regulatory acts to establish policy frameworks in the specified area.
- Prepare initial drafts of regulatory acts necessary for policy development.
- Coordinate prepared draft regulatory acts with relevant government agencies and other stakeholders.
- Review and analyze feedback and proposals from other government agencies and local authorities concerning the prepared draft regulatory acts.
- Contribute to the consolidation of feedback received from these stakeholders for the improvement of the draft regulatory acts.
- Analyze comments and suggestions from the public on proposed policies and regulations.
- Actively participate in working group sessions, meetings, and discussions focused on shaping policies in the specified areas.
- Prepare analytical materials, briefs, conclusions, and presentations related to housing rights and the associated regulatory framework for war veterans.
- Provide regular reports on the results of activities to the Representative of the Ministry of Veteran`s Affairs and IOM.
- Perform such other duties as may be assigned.

All the deliverables under this Section are subject of approval by IOM. The Consultant will also deliver to IOM the electronic files of all gathered documents that were used as a source for the consultancy. Any delay in reaching the deliverables which is not under the control of the Consultant will be coordinated with IOM that will undertake corrective actions.
Taking into consideration the necessity to work in close cooperation with the Ministry, it is obligated for the Analyst to cooperate with the Ministry regularly and spend minimum 32 working hours out of 40 working hours per week at the Ministry or IOM (in Kyiv), specifically through taking part in offline meetings with the Ministry and/or offline events, organized by the Ministry or other related stakeholders.
- Performance indicators for the evaluation of results.

The Analyst will support the Ministry of Veterans Affairs in enhancing its capacity to coordinate and implement projects related to the housing rights of war veterans and the families of fallen soldiers. This includes developing policies, monitoring programs, and providing recommendations to improve housing access for these individuals.
The analyst’s work will be summarized in monthly reports, submitted by the 25th of each month. These reports will outline progress, results, and recommendations, ensuring alignment with the Ministry’s goals and the analyst’s scope of work. The reports will also include updates on the development of regulatory acts and coordination with relevant stakeholders.
- Education:
- Master’s degree (or higher) in Law, Public Administration, Political Science or a closely related field from an accredited institution. A relevant academic degree will be an advantage.
- Experience:
- At least 5 years of professional experience in conducting comprehensive legal and regulatory analysis in areas such as housing rights, social programs, and veterans' affairs.
- Strong background in analysing and interpreting national housing policies and displacement-related compensation mechanisms.
- Experience in developing and drafting regulatory acts, policies, or laws, particularly in areas related to housing or veterans' rights.
- Practical experience in the field of veterans' affairs (politics, law, institutional relations, etc.), including participation in the development of strategic documents and policies on the reintegration of veterans.
- Experience in conducting research and results analysis.
- Experience in researching and analyzing international best practices and comparative legal frameworks, particularly in the areas of housing for veterans, social inclusion, and temporary accommodation support for displaced persons.
- Experience of interaction with government, diplomatic institutions, and international organizations.
- Experience in creating partner networks with non-governmental organizations from different regions of Ukraine.
- Work experience and understanding of the socio-political situation and veteran policy in Ukraine is an advantage.
- Skills:
- Excellent written and oral communication and negotiation skills.
- Strong analytical skills for interpreting legal and regulatory frameworks.
- Ability to collaborate effectively with stakeholders to influence policy development and implementation.
- Expertise in drafting and refining policy recommendations based on legal analysis and research findings.
- Language proficiency:
- Proficiency in Ukrainian, and English.
- Travel required:
- Travel duties are possible according to the Agreement.
